Honourable Supreme Court of India, the highest court in India suffered on the lack of mutual decision between judges which led the four senior lawyers of the Supreme Court to the public court. The four judges Justices J Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph were not happy that the Chief Justice of India Dipak Mishra passed the case to Justice Arun Mishra without their opinion. To be more specific the judges were unhappy that the two PIL(Public Interest Litigation) on special CBI judge BH Loya’s death were headed to Arun Kumar Mishra without their intervention.
Judge Loya was hearing the case of BJP President Amit Shah who was accused for a murder. During this period Judge Loya died in 2014. Medical records suggest that Judge Loya died of cardiac arrest but his family alleged that he was under severe pressure when he was handling the case. According to the four judges this case deserved an independent enquiry by the judges but it was assigned to a bench that doesn’t have the four senior judges.
This is the first type of incident that has happened in the history of Supreme Court that senior most judges have appeared in the public court. Chief Justice was also accused of indulging inappropriately in a case regarding judicial corruption. There have been some strong reasons that has compelled the four judges to take this action. These judges are the senior-most in the country and we hope that they soon come to an understanding so that this matter could be resolved.
